Search Berkeley County Court Records

Berkeley County court records are searched through South Carolina trial-court, family, probate, magistrate, municipal, sheriff, and county public-record channels. A Berkeley County Court case search may start with the statewide case-record selector, but the right office depends on the case type. Civil and criminal case indexes, family matters, probate estates, traffic tickets, warrants, and jail custody records each follow a different path. South Carolina court access also has limits for family, juvenile, sealed, and personal identifying information, so public lookup tools and certified records are not the same thing.

Berkeley County Court System

Berkeley County is in South Carolina's Ninth Judicial Circuit with Charleston County. The primary trial court is Circuit Court, not a district court. Circuit Court has two main divisions: the Court of Common Pleas for civil cases and the Court of General Sessions for criminal cases. Family Court is a separate statewide trial court for divorce, custody, support, adoption, name change, and other domestic matters. Probate Court handles estates, guardianship, conservatorship, marriage licenses, mental health matters, alcohol and drug commitment matters, and minor settlements.

Lower-level court records may sit outside Circuit Court. Magistrate Court handles summary criminal and traffic matters, preliminary hearings, bond court, small claims, evictions, and some warrants. Municipal Court handles city ordinance violations, city traffic charges, and municipal misdemeanors. Appeals from lower trial courts generally move to Circuit Court, while appeals from Circuit Court go to South Carolina appellate courts.

Types of Berkeley County Court Records

Berkeley County court records include civil, criminal, family, probate, traffic, protective-order, and lower-court files. Civil matters in the Court of Common Pleas may include complaints, answers, motions, orders, judgments, liens, transcripts of judgment, lis pendens filings, and dismissal entries. Criminal matters in General Sessions may include charges, indictments, bond, arraignment or appearance entries, trial docket events, plea or verdict information, disposition, sentence, probation terms, costs, and fines.

Some case types require a different access route. Family Court is the sole forum for divorce, legal separation, custody, visitation, termination of parental rights, adoption, support, alimony, marital-property division, and name change. Probate Court keeps estate and marriage-license records. Magistrate and Municipal Courts handle many traffic, misdemeanor, small-claims, eviction, and ordinance matters before a case ever reaches Circuit Court.

  • Civil court records come from Common Pleas and are indexed by plaintiff and defendant.
  • Criminal court records come from General Sessions and are indexed by defendant.
  • Family court records include divorce and custody files, but access is confidential or permission-limited.
  • Probate records cover estates, guardianships, conservatorships, marriage licenses, and minor settlements.
  • Traffic court records may be in Magistrate Court, Municipal Court, Circuit Court, or the SC.GOV payment system.

The South Carolina Judicial Branch Family Court page explains why some domestic records follow a different public-access path.

Berkeley County court records Family Court access

That separate family-court structure is why a general Public Index search may not answer every divorce, custody, or support-record question.

What Berkeley County Court Records Show

A court record is more than a name match. Berkeley County court records can show the case number, court, county, circuit, party names, filing date, case type, status, charges, docket entries, hearing dates, judge, courtroom, costs, fines, bond, restitution, and disposition. Civil files use terms such as plaintiff and defendant. Criminal files use defendant, charge, bond, plea, conviction, disposition, sentence, and probation. Probate and family matters use petitioner, respondent, personal representative, guardian, conservator, or other case-specific roles.

Online portals do not always show the full case file. Research found that the Berkeley Public Index could not be fully inspected through command-line access because the official portal requires browser features and returned errors outside a normal browser. The practical rule is to treat the portal as an index and docket access point. For certified copies, full file review, restricted records, or questions about missing docket entries, use the Clerk of Court, Family Court, Probate Court, Magistrate Court, Municipal Court, or Solicitor contact tied to the case.

FieldWhat It Means
Case NumberUnique identifier used for portal searches, copy requests, docket checks, and ticket payments.
PartiesPlaintiff and defendant in civil cases, defendant in criminal cases, or petitioner and respondent in family/probate matters.
Docket EntriesChronological filings, hearings, motions, orders, continuances, judgments, dispositions, and sentencing events.
DispositionThe outcome of a case or charge, such as dismissed, nolle prossed, guilty plea, verdict, judgment, or closed status.
Financial FieldsFiling fees, costs, fines, restitution, bond, payment due, or support-payment history when public and applicable.

Berkeley County Court Records Access Laws

South Carolina's public-record framework starts with the Freedom of Information Act, Title 30, Chapter 4, but court records are often reached through court-specific portals and clerk offices rather than a county FOIA request. Berkeley County's FOIA page says county FOIA requests must be filed through the online portal and that email or fax requests stopped being accepted on August 1, 2020. That portal is a county administrative-record fallback, not a substitute for a court case index or certified court copy process.

Several limits shape Berkeley County court records access. Title 30, Chapter 2 protects personal identifying information and restricts commercial solicitation uses. The Clerk FAQ says Family Court records are confidential and may be inspected only with special permission. Juvenile delinquency, adoption, terminated parental rights, abuse and neglect, and sealed records are confidential. The Judicial Branch also states that home address information is no longer displayed on the public index for new or existing cases as of January 1, 2026.

Key Statutes:

S.C. Code Ann. Section 30-4-30 governs inspection, copying, fees, and public-record response duties.

S.C. Code Ann. Section 30-4-40 lists exemptions, including law-enforcement and body-camera limits.

S.C. Code Ann. Section 17-22-910 et seq. places many criminal expungement applications with the Solicitor's Office.

S.C. Code Ann. Sections 63-19-2010 and 63-19-2020 restrict juvenile court record inspection.

Restricted Berkeley County Court Records

Restricted court records are not just hard to find online. Some are confidential by law, court rule, or court order. Berkeley County Clerk materials specifically identify Family Court records as confidential and state that they may be inspected only with special permission. The same research identifies juvenile delinquency, adoptions, terminated parental rights, abuse and neglect, and sealed records as confidential. Personal identifiers such as Social Security numbers, driver's license numbers, passport numbers, financial account numbers, PINs, and passwords are protected under South Carolina privacy law.

Expungement is a separate process. South Carolina law places many criminal-record expungement applications with the Solicitor's Office in the circuit where the case was handled. In Berkeley County, that points to the Ninth Judicial Circuit Solicitor. A person usually needs the exact charge, disposition, court, and case number before applying. If an expungement order is granted, eligible official records are removed, destroyed, or sealed as the order directs. Private databases may not update at the same time.

Berkeley County Sheriff and Jail Records

The Berkeley County Sheriff's Office is led by Sheriff S. Duane Lewis and provides law-enforcement, detention, records, and public-safety services. The Hill-Finklea Detention Center has a 24-hour main line, booking phone, records phone, and detention public contact channels. The official inmate lookup allows current-custody searches by name and by charge terms, and the research confirms partial-name searching. The sheriff's office also maintains incident reports, arrest or charge paperwork submitted by deputies, dispositions, expungement orders, subpoenas, Rule 5 motions, and crime-data submissions to SLED.

Sheriff records are not the same as court records. Incident reports can be requested from the Sheriff's Records Management Office in person with picture identification, and reports are available after 1:00 p.m. five business days after the incident report date. Criminal histories are not handled locally by the sheriff; they go through SLED CATCH. For custody details, use the sheriff lookup, Hill-Finklea phone lines, SCDC for state-prison inmates, and VINELink for custody notifications. The full jail workflow is covered in Berkeley County inmate records.

The Berkeley County Sheriff's Office homepage is the official starting point for sheriff services and public-safety links.

The sheriff source is most useful for custody, incident-report, app, tip, and detention questions that do not belong to the Clerk of Court.

Berkeley County Marriage Divorce Probate

Marriage licenses and probate records are handled by Berkeley County Probate Court, while divorce is a Family Court matter. Probate Court issues marriage licenses, files executed licenses with the state health agency, keeps a permanent record of licenses issued and returned after ceremony, and prepares certified copies of Berkeley County marriage licenses. The marriage license filing fee in the research is $50, and the waiting period is 24 hours after receipt of the application. If the online application has missing or incorrect information, Party A receives an email requesting more information or documentation.

Probate estate access is more detailed than a simple name search. Estate opening can require the original death certificate, valid picture ID for anyone signing documents, cash or check payable to Berkeley County, mailing or email addresses for heirs, the original will if one exists, and fee payment. Small estates require a 30-day wait after death, no real estate, and an estate value under the local threshold stated by Probate Court. Divorce files and certified family-court records follow the Clerk and Family Court access process with confidentiality limits.

Personal Representative
The person who administers an estate, often called the executor when named in a will.
Intestate
A death without a valid will, so priority and distribution follow South Carolina law.
Conservator
A person appointed to manage financial or property affairs for someone who cannot manage them alone.
Rule to Show Cause
A court order requiring someone to explain why they have not complied with a court duty.

Berkeley County Court Record Fees

Berkeley County research confirms copy charges but did not locate a Clerk-specific plain-copy or certification schedule on the official Clerk pages reviewed. The safest path for court-record copies is to search the index first, then contact the Clerk for the current copy and certification amount before ordering. Circuit Court filing fees are published by the South Carolina Judicial Branch and are useful context for case-file costs, but they are not the same as certified-copy charges.

Berkeley County Court Context

Local context helps explain why Berkeley County court records are split across several offices. The county seat is Moncks Corner, and the U.S. Census QuickFacts page lists Berkeley County with 1,103.62 square miles of land area in 2020, a 2020 population density of 208.3 per square mile, and FIPS code 45015. The sheriff welcome page describes an agency serving more than 237,000 people across a growing county, which helps explain why county, magistrate, municipal, sheriff, and state portals all appear in the access chain.

Berkeley County Court History

The Clerk history page ties Berkeley County records to the statewide Circuit Court structure. South Carolina Circuit Court is divided into the Court of Common Pleas for civil cases and the Court of General Sessions for criminal cases. Berkeley and Charleston Counties form the Ninth Judicial Circuit. The same official history states that South Carolina has sixteen judicial circuits, Circuit judges rotate among circuits, and Circuit judges are elected by the General Assembly to six-year terms.

Family Court has a separate statewide history. The uniform statewide Family Court System was established by statute in 1976 and follows the territorial boundaries of the sixteen judicial circuits. Berkeley County also has recent lower-court changes. The Goose Creek Magistrate's Office moved to 653 Red Bank Road and reopened for normal business hours on May 5, 2025, in a new Magistrate and Public Safety Substation that also houses EMS and sheriff substation functions.

The Berkeley County Clerk of Court page identifies the local Clerk office and court-record responsibilities.

Berkeley County Court Records FAQ

Where does a Berkeley County court records search start?

Most Circuit Court civil and criminal searches start with the South Carolina Judicial Branch case-record selector, then the Berkeley County Public Index. Family, probate, magistrate, municipal, sheriff, and traffic-payment records can require different official channels.

Are Berkeley County Family Court records public?

Family Court records are confidential under the Berkeley Clerk FAQ and may be inspected only with special permission. Divorce is a Family Court matter, so a public search may not show the full file or certified copies.

Can the sheriff provide a criminal history?

No local criminal-history checks are handled by the sheriff's office according to the Sheriff's Records Management page. Statewide criminal-history background checks go through SLED CATCH.

Where are Berkeley County probate records searched?

Probate Court links to the PAWS Portal or Estates Lookup for estate searches. Walk-ins are accepted by the Estates Division during the posted estate walk-in window, and Probate Court also uses a front-courthouse drop box during posted hours.

What if a city ticket has a warrant warning?

Call the municipal court that issued the ticket or charge. Moncks Corner Municipal Court specifically warns that failure to pay or appear may lead to a bench warrant and license suspension, and callers should have the ticket or warrant number ready.
